DMCA & Intellectual Property Policy

Information Officer LLC ("Information Officer") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws, we will respond expeditiously to notices of alleged infringement.
Repeat Infringer Policy
As part of our safe harbor requirements, Information Officer maintains a "repeat infringer" policy. We reserve the right to terminate, in appropriate circumstances, the accounts of customers or users who repeatedly infringe the copyrights of others. This typically includes users who receive three (3) valid infringement notices within a 12-month period, though we reserve the right to terminate accounts immediately for egregious violations.
1. Filing an Infringement Notification
Important: You must consider whether "Fair Use" or other legal exceptions apply before submitting a notice. Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability.
To file a notice, please provide a written communication (email preferred) containing the following:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, including the specific URL or location.
- Your contact information (name, address, telephone number, and email).
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
2. Filing a Counter-Notification
If your content was removed by mistake or misidentification, you may file a counter-notice. It must include:
- Your physical or electronic signature.
- Identification of the material that has been removed and the location where it appeared.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or San Francisco, CA if outside the US), and that you will accept service of process from the person who provided the original notification.
